1. The service

CommerceOS provides hosted e-commerce software: storefronts, a merchant dashboard, a visual theme editor, catalog and order management, checkout infrastructure, and related tooling. The service is provided by Bizzar Marketing, Murgasole, Asansol – 713303, West Bengal, India. We host and operate the software; you operate your store and your business.

2. Service status

CommerceOS is under active development. Features may change, be added, or be removed, and occasional interruptions can occur. We treat your store data as production data — it is isolated per store and backed up — but the service is provided with the understanding that it is still maturing.

3. Your account

• You must provide accurate information when creating an account and keep it current.
• You are responsible for safeguarding your credentials and for all activity under your account.
• You must be able to form a binding contract in your jurisdiction to use the service.

4. Merchant responsibilities

Stores on CommerceOS are independent businesses. As a merchant you are solely responsible for the products you sell, their legality, product claims and descriptions, pricing, taxes, shipping and fulfilment, customer service, and your store’s own policies (returns, refunds, shipping, privacy). Neither CommerceOS nor Bizzar Marketing is a party to the transaction between you and your customers.

5. Acceptable use

• No illegal goods or services, and no content that infringes the rights of others.
• No attempts to breach tenant isolation, probe, or disrupt the platform or other stores.
• No use of the platform to send spam or engage in deceptive practices.

We may suspend or remove stores that violate these rules.

6. Fees

Every plan begins with a 14-day free trial. Signing up requires saving a payment method and authorising a recurring instruction for the plan you choose; nothing is debited during the trial. The first charge is the plan price on the day the trial ends, and monthly thereafter, until you cancel. Cancelling during the trial revokes the instruction and no charge is raised. Current pricing is always published on the website and existing merchants will receive advance notice before any change to it. Payment processing fees charged by payment providers (e.g. Stripe or Razorpay) are separate and set by those providers. Because each period is billed in advance and served in full, a charge that has been raised is not refundable; cancelling stops all future charges and your access runs to the end of the period already paid for. Our Refund & Cancellation Policy covers subscription charges in full, including billing errors.

7. Your data

You own your store’s data — catalog, content, customers, and orders. We process it to provide the service, as described in the Privacy Policy. You can export your theme and catalog data, and you may request deletion of your store.

8. Intellectual property

The platform, including its software, design, and branding, belongs to Bizzar Marketing. You retain all rights to the content you upload. You grant us the limited licence needed to host and display that content in order to run your store.

9. Termination

You may close your store at any time. We may suspend or terminate accounts that breach these terms, create risk for the platform or other merchants, or where required by law. Where practical we will give notice and an opportunity to export your data.

10. Disclaimers and liability

The service is provided “as is” without warranties of any kind to the fullest extent permitted by law. To the same extent, Bizzar Marketing is not liable for indirect or consequential losses, loss of profits, or loss of data, and our aggregate liability for any claim is limited to the amounts you paid us in the twelve months before the claim (or ₹1,000 if you paid nothing).

11. Governing law

These terms are governed by the laws of India, and disputes are subject to the jurisdiction of the courts at Asansol, West Bengal.

12. Changes

We may update these terms as the product evolves. Material changes will be announced on the website or by email, and the “last updated” date above will change. Continued use after a change means you accept the updated terms.
